Organic co-op surrenders grain dealer license in South Dakota

Organic Producers of Iowa Nebraska South Dakota (OPINS) engaged in 33 transactions with producers without a license.

Nebraska-based Organic Producers of Iowa Nebraska South Dakota (OPINS) is surrendering its grain dealer’s license in South Dakota as part of a settlement with the South Dakota Public Utilities Commission. The co-op of organic farmers will also pay a $5,000 fine.

According to the settlement, OPINS engaged in 33 transactions with 12 South Dakota producers between June 30, 2019, and November 8, 2021, when the co-op didn’t have a valid South Dakota grain-buying license.

OPINS could have faced a maximum penalty of $20,000 since at least 20 purchases were alleged to have taken place.

KELOLAND reports the decision to accept the settlement Tuesday marked the first time the South Dakota Public Utilities Commission had taken such an action over a grain-buying matter.

The co-op can apply for a new South Dakota license in June 2023.
