Farmers Must Prove Right to Sue Over CGB Elevator

Judge heard request for restraining order from farmers Thursday

Even as trucks rolled in and barges waited to be filled in Brandenburg, KY, a judge was ready to hear the case that could keep the grain elevator open past the end of January, reports WHAS11 News.

The Lincoln Trail Grain Growers Association filed suit against Meade County, Nucor and Consolidated Grain and Barge (CGB).

Thursday, a Meade County judge heard a request for a restraining order which farmers hoped would prevent the elevator’s planned closing on January 31.

Attorneys for the farmers filed a suit claiming the $1.3 billion deal to build a steel plant on the riverport site violated the Open Meetings Act and Kentucky Constitution.

The attorney for the county argued that the farmers, as a group that formed recently, don't have the right to sue.
