Settlement Reached in Nebraska Grain Elevator Explosion

City receives $75,000 to reimburse funds spent on response to incident

The city of South Sioux City, NE, has reached a $75,000 settlement of a lawsuit seeking reimbursement of funds the city spent responding to a 2018 grain elevator explosion at Andersen Farms Inc.

The agreement was reached last month during a mediation session.

The city in February sued Andersen Farms Inc., Andersen Family Farms, Bryce Andersen and Luanne Andersen, seeking payment of a $120,034 invoice it sent for payment of emergency expenses the city incurred in response to the May 29, 2018, explosion.

The city is entitled to reimbursement of emergency expenses from the owner of a premises that has been deemed an unsafe structure and must be secured, according to city code cited in the lawsuit, filed in Dakota County District Court.

The May 29 blast blew a hole in the elevator and injured an employee who died July 9 .
